Terms of Service for VoteVoteWin LLC

Welcome to VoteVoteWin LLC ("we," "our," or "us"). By accessing or using our web-based application, you agree to comply with and be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

 By using VoteVoteWin, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use our services.

2. Description of Services

VoteVoteWin provides tools for U.S. election campaign managers to increase campaign awareness and voter turnout. Users can upload voter data, add volunteers, and facilitate outreach through personal communication.

3. User Responsibilities

Account Security: Users are responsible for maintaining the confidentiality of their login credentials.

Mobile Number and Verification: When you register for a volunteer account, you provide a mobile phone number. We use this number to create and verify your account, to authenticate logins, and to send account-related messages as described in Section 6 (SMS/Text Messaging Terms). You are responsible for keeping your mobile number current and for notifying us if it changes or is no longer under your control.

Lawful Use: The platform must be used in compliance with applicable laws and regulations, including election-related regulations.

Accuracy of Information: Users must provide accurate and current information when creating accounts and uploading data.

4. Prohibited Activities

Users may not:

  • Use the platform for any fraudulent, abusive, or unlawful activity.

  • Upload or distribute content that infringes on others' rights.

  • Attempt to access unauthorized areas of the application.

5. Data Usage and Privacy

We handle user data as described in our Privacy Policy. VoteVoteWin does send transactional, account-related text messages—such as verification codes, login authentication, password resets, and security notifications—directly to registered users through a third-party messaging service provider. These account messages are distinct from campaign outreach: VoteVoteWin does not send outreach messages on behalf of campaigns, and such messages continue to be sent directly from volunteers' personal devices. Our SMS/Text Messaging Terms are set out in Section 6.

6. SMS/Text Messaging Terms

 By providing your mobile phone number when creating a VoteVoteWin account, you consent to receive transactional text messages from VoteVoteWin related to your account, including account verification codes, login authentication, password resets, and account security notifications.

Message frequency varies based on your account activity. Message and data rates may apply. Check with your mobile carrier for details on your plan.

Opting Out: You may opt out of text messages at any time by replying STOP to any message. After you send STOP, we will send one final message confirming that you have been unsubscribed. No further messages will be sent unless you re-enroll. Note that opting out of account security messages may limit certain features of your account, including phone-based verification.

 Consent to receive text messages is not a condition of creating an account or volunteering. Carriers are not liable for delayed or undelivered messages. VoteVoteWin may use automated technology to send the messages described above.

 We do not share or sell mobile phone numbers or SMS consent data with third parties or affiliates for marketing or promotional purposes. For more information on how we handle your data, see our Privacy Policy.

7. Intellectual Property

All content, trademarks, and intellectual property within the platform are owned by VoteVoteWin LLC or licensed for use. Users may not copy, distribute, or create derivative works without permission.

8. Limitation of Liability

VoteVoteWin LLC is not liable for:

  • Indirect, incidental, or consequential damages arising from platform use. 

  • Actions or communications initiated by volunteers.

  • Data inaccuracies or unauthorized data access despite our security measures.

  • Delayed or undelivered text messages, or charges imposed by your mobile carrier.

9. Termination of Access

We reserve the right to suspend or terminate accounts that violate these Terms or engage in activities harmful to the platform or other users.

10. Modifications to Terms

We may update these Terms from time to time. Changes will be communicated through the platform and take effect upon posting.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
